Food Establishment Permit Application

The Marfa City Council has passed Ordinance No. 2022-03, which adopts the state rules known as the Texas Food Establishment Rules and makes them enforceable within the city limits of Marfa.  Beginning on March 31, 2022, all food establishments including food service establishments, retail food stores, temporary food establishments, mobile food units, and roadside food vendors within the city limits will be required to have a permit posted on site to operate.  Permits must be renewed annually.  There is currently no fee for permits. 

The purpose of this ordinance is to protect both public health and the public wastewater system.  Provisions regarding permit applications, inspections, suspensions, and revocations are contained in the ordinance.  Non-profit organizations are exempt from permitting requirements, but must comply with state rules.  Beginning March 31,  2022, no food establishments may operate without a permit.  Upon conviction, violators may be fined up to $2,000.00 plus costs of court.
